Event Details
Much confusion and uncertainty has surrounded the Broad-Based Ownership Schemes (B-BOSs) and Employee Share Ownership Programs (ESOPs), with the BBBEE Commission's interpretation often in conflict to the DTIC's announcements. Minister Ebrahim Patel in May 2021 finally clarified and gazetted the correct interpretation, which meanings and implications will be presented in our Webinar.
An expert in legal matters involving B-BBEE, Ms. Hanlie Malan of Vogel Malan Attorneys will guide us through the Practice Note 1 of 2021 on "Rules for Discretionary Collective Enterprises"; as published in the Government Gazette on 18 May 2021. Topics addressed include:
- Correct interpretation and the application of the legislation identifying participants;
- Interpretative misalignment on how Discretionary Collective Enterprises such as B-BOSs, ESOPs, Trade Unions, Investment Holding Companies that are B-BOSs, Not for Profit Companies (NPCs) and Trusts amongst other juristic persons should be treated in terms of the Broad Based Black Economic Empowerment legislation;
- Rules for Collective Enterprises
- Practical Implication;
- Q&As
Of particular interest to foreign companies operating in South Africa, where Ownership has been a
problematic element on their B-BBEE Scorecard.
